These Terms & Conditions (the Terms) form a binding agreement between you and DIGIBROOD, the company behind Crimbox (DIGIBROOD, 22, DEB KAMINI DEBI LANE, KOLKATA, North 24 Parganas, West Bengal, 700076). By creating an account, accessing or using Crimbox, you agree to these Terms. If you do not agree, please do not use the service.
1. Definitions
Service means the Crimbox website, applications and related services. You or User means the person or business using the Service. Content means any data you create or upload.
2. Eligibility & account
You must be at least 18 and able to enter a binding contract. You are responsible for all activity under your account and for keeping your login credentials secure. Notify us immediately of any unauthorised use.
3. Acceptable use
You agree not to misuse the Service, including: sending spam or unsolicited messages; violating the WhatsApp Business and Meta policies; uploading unlawful, harmful or infringing content; attempting to breach security; or reselling the Service except under an approved partner agreement.
4. Subscriptions, billing & taxes
Paid plans are billed in advance on a monthly or yearly cycle. Yearly plans are offered at a discount. Fees are stated exclusive of taxes; applicable GST and other taxes will be added. Prices may change with prior notice; changes do not affect the period you have already paid for.
5. Messaging & third-party charges
WhatsApp conversations are billed by Meta at their published rates. DIGIBROOD does not add a markup to Meta's messaging charges, but these are separate from your plan fee and are your responsibility. AI features consume credits as described in your plan.
6. Your content & responsibilities
You retain ownership of your Content. You grant us a limited licence to host and process it solely to provide the Service. You are solely responsible for your Content and for obtaining any consents required to contact the people you store in Crimbox, and for complying with all applicable marketing, privacy and data-protection laws.
7. Intellectual property
The Service, including its software, design and trademarks, belongs to DIGIBROOD and its licensors. These Terms do not transfer any ownership of the Service to you.
8. Suspension & termination
We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that risks harm to others or to the platform. You may stop using the Service at any time as described in our Cancellation Policy.
9. Disclaimers
The Service is provided on an as-is and as-available basis. We work hard to keep it reliable but do not warrant that it will be uninterrupted or error-free.
10. Limitation of liability
To the maximum extent permitted by law, DIGIBROOD shall not be liable for any indirect, incidental or consequential loss, or loss of profits, revenue or data. Our total liability for any claim is limited to the fees you paid for the Service in the three months before the claim.
11. Indemnity
You agree to indemnify DIGIBROOD against claims arising from your Content, your use of the Service, or your breach of these Terms or of any law.
12. Governing law
These Terms are governed by the laws of India. Subject to applicable law, the courts at Kolkata, West Bengal shall have exclusive jurisdiction.
